SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV- 2012 -003 <br />NATURE OF VIOLATION: <br />Failure to dispose of Coal Mine Waste in compliance with the King Coal Permit, No. C- 1981 -035, and with the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT SECTION(S): 121(2)(d), 121(2)(e) <br />REGULATIONSECTION(S): 4.09.1, 4.09.2, 4.10, 4.11 <br />PERMIT SECTION(S): 2.05.4 page 4 <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />Coal Mine Waste from the King II Mine has been used to backfill the King I Mine tipple area highwall and benches, as <br />observed during the Division's March 21, 2012 inspection. The configuration of placement differs from that described <br />in the permit, and no supporting documentation has been provided to show that the Coal Mine Waste was designed, <br />placed, and inspected in accordance with the performance standards of Sections 4.09.1, 4.09.2, 4.10, and 4.11. <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />Abatement Description <br />Step # <br />1 Dispose of all Coal Mine Waste in compliance with Rules 4.09.1, 4.09.2, 4.10, and 4.11. <br />TIME FOR ABATEMENT (NOT MORE THAN 90 DAYS): <br />ON OR BEFORE: May 31, 2012 <br />Abatement Step # Due Date <br />1 May 31, 2012 <br />
