STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
April 5, 2012
Ron Thompson
New Elk Coal Company, LLC
122 West First Street
Trinidad, CO 80182
Re: New Elk Mine (Permit No. C- 1981 -012)
Minor Revision No. 110 (MR -110)
Update text, Map 11 -Sheet 2, Map 12. Remove approval of East Portal heaters
Dear Mr. Thompson:
COLORADO
p I V I S I O N O F
RECLAMATION
MINING
SAFETY
John W. Hickenlooper
Governor
Mike King
Executive Director
Loretta E. Pineda
Director
We have received your minor revision application to revise your permit to conduct coal mining in Colorado. Our initial review
indicates that all preliminary items required by the Colorado Surface Coal Mining Reclamation Act, Section 34 -33 -101 et seq., C.R.S.,
have been submitted. Thus, your application has been considered complete for the purposes of filing as of April 4, 2012. All review
and comment periods as provided in the Act and the Regulations initiate from this date of filing.
The Division has reviewed your revision application to determine whether the items you have submitted are adequate in terms of
meeting the requirements of the Act and Regulations. Please find the following adequacy concerns identified by the Division_
1. NECC is proposing to remove costs for reclamation of two East Portal air intake heaters, and associated gas line and
propane tank, Exhibit 28 -Page 167. The previous approval (TR55) text is also removed from permit page 2.05 -5d. Please
provide a replacement page for Exhibit 28 -Page 167, stating why this page is blank, for continuity of pagination, e.g. "Page
replaced with MRI10 ".
2. Map 11 -Sheet 2:
a) The waterline that runs from the north side of Colorado Highway 12, along the south side of the DWDA #2, is not
shown. The Division is concerned that eliminating this waterline from the map may result in future damage to the line
if maps do show where it is buried. Please add this waterline back on to the map.
b) There is no potable waterline shown coming down the slope from either the 25K water tank or the 400K tank. Please
show the route of the potable waterline (Raw waterline is shown, but the legend shows two different colors for the raw
water versus the potable water. This potable (city) water line was shown on Map i 1 -Sheet 2 approved with MR104
(revised date 12/19/2011.
Please provide updates to Exhibit 28, and Map 11 -Sheet 2 prior to April 13, 2012. The Division will either issue a decision or inform
you of adequacy issues regarding the application on or before April 14, 2012.
If you have any questions, please contact me.
Sincerely,
a
Janet H.
