Pineda <br />Director <br />We have received your minor revision application to revise your permit to conduct coal mining in Colorado. Our initial review <br />indicates that all preliminary items required by the Colorado Surface Coal Mining Reclamation Act, Section 34 -33 -101 et seq., C.R.S., <br />have been submitted. Thus, your application has been considered complete for the purposes of filing as of April 4, 2012. All review <br />and comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />The Division has reviewed your revision application to determine whether the items you have submitted are adequate in terms of <br />meeting the requirements of the Act and Regulations. Please find the following adequacy concerns identified by the Division_ <br />1. NECC is proposing to remove costs for reclamation of two East Portal air intake heaters, and associated gas line and <br />propane tank, Exhibit 28 -Page 167. The previous approval (TR55) text is also removed from permit page 2.05 -5d. Please <br />provide a replacement page for Exhibit 28 -Page 167, stating why this page is blank, for continuity of pagination, e.g. "Page <br />replaced with MRI10 ". <br />2. Map 11 -Sheet 2: <br />a) The waterline that runs from the north side of Colorado Highway 12, along the south side of the DWDA #2, is not <br />shown. The Division is concerned that eliminating this waterline from the map may result in future damage to the line <br />if maps do show where it is buried. Please add this waterline back on to the map. <br />b) There is no potable waterline shown coming down the slope from either the 25K water tank or the 400K tank. Please <br />show the route of the potable waterline (Raw waterline is shown, but the legend shows two different colors for the raw <br />water versus the potable water. This potable (city) water line was shown on Map i 1 -Sheet 2 approved with MR104 <br />(revised date 12/19/2011. <br />Please provide updates to Exhibit 28, and Map 11 -Sheet 2 prior to April 13, 2012.
