Photographs <br />were reviewed by Marcia Talvitie of the DRMS Durango Field Offi ce. Skies were clear. Division <br />personnel had conducted a partial inspection of this mine, on the ground, on October 26 and 27, 2011. <br /> <br />BACKFILL and GRADING – Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination <br />4.14.1(2)(f); Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of <br />Rills and Gullies 4.14.6: <br /> The lower portion of the pit backfill consists of “Bench 2” overburden and interburden, which is <br />fragmented using explosives, and either pushed by bulldozer or hauled by truck and dumped behind <br />the active pit. This material is typically gray in color, an d is clearly visible in Photos 4, 5 and 8 . <br /> The upper level of the backfill is “Bench 1” overburden, which is usuall y free -dug by the shovel and <br />loaded into trucks for transport to the back side of the pit. The material is dumped onto the graded <br />top surface of the replaced Bench 2 overburden. <br /> On the Morgan property, two stockpiles of free -dig material have been constru cted. These piles are <br />identified as “OB1”, and are for the purpose of backfilling the upper level of the final cuts on this <br />parcel. <br /> <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge St ructures 4.05.7, <br />4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water <br />Monitoring 4.05.13; Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream <br />Buffer Zones 4.05.18: <br /> Pond 007 is bisec ted by 5th Road, which runs E -W. The two parts of the pond are connected by two <br />culvert pipes, at differing elevations, which pass through the roadway embankment. The primary <br />spillway, consisting of a vertical pipe, is located in the southwest corner of the pond. The pond <br />discharges into Calamity Draw. These features are circled in yellow on Photo 1. Pond 007 is on a <br />parcel owned by San Miguel Power Association, and has been approved as a permanent feature. The <br />surface of the pond was speckled with nu merous waterfowl. <br /> Pond 008 is located on the Burbridge property, and has been approved for retention as a permanent <br />structure. The pond appears in Photo 2, and was partially filled with water. <br /> Pond 009 was dry, as shown in Photo 7. This pond is situated on the Benson -West parcel, and
