DEI'1NITION OF EFFLUENT LIMITATIONS <br />L Effluent Limitatio <br />Beginning no later than the effective date of this permit and lasting through the expiration date of the permit, the permittee is authorized to <br />discharge from outfalls 001A through 0 1 2A the discharges froni sedimentation ponds- -all prior to entering state waters.ln accordance with <br />the 'Mater Quality Control Commission Regulations for Effluent Limitations, Section 62.1, and the Colorado Discharge Permit System <br />Regulations, Section 61.8(2), 5 G.C.R. 1002 -61, the permitted discharge shall not contain effluent parameter concentrations, which exceed <br />the following limitations specified below or exceed the specified flow limitation. <br />a. Alternate Limitatio Burden of Proof Requirements <br />The permittee has the burden of proof when seeking relief front total suspended solids (TSS), total or total recoverable iron, and/or <br />settleable solids (SS) lirtritations, as applicable. All Outfalls are eligible for relief fz•om'I'SS or total recoverable iron, and SS; however, the <br />majority ofthe loading froni any discharge has to consist of storm ninoff for the relief to be available. The permittee will need to show that <br />exceedence of the applicable limitations was caused by precipitation and not mine water, through a comparison of the loading from each <br />source. Relief may be granted for each discharge occurrence only when necessary and shall not be grained when the permittee has control <br />over the discharge. The permittee should endeavor to meet the primary limitations whenever possible. <br />MODIFIED AND EFFECTIVE: JULYS 2007 EXPIRATION. 29 2010 <br />
