Compliance With Mine Plan NA - Support Facilities Not On-site <br /> R - Other NA - Special Categories Of Mining <br /> NA -Processing Waste Y - Topsoil <br /> COMMENTS <br /> This was a Complete Inspection of the King Coal Mine conducted by Marcia Talvitie of the <br /> DRMS on Wednesday, March 21, 2012. Skies were clear, and the temperature was cool. I <br /> arrived at the King 11 surface facilities at 11:30 a.m., and proceeded to the Coal Sales Building to <br /> sign in and update my annual site-specific MSHA certification. For the inspection at King 11, I <br /> was accompanied by James Counts and Wade Wymore. Mr. Wymore has recently been assigned <br /> supervisory responsibility for the surface facilities, replacing Jim Jarvis. At 12:50 I began the <br /> records check, after which Tom Bird accompanied me to the King I facilities area. The <br /> inspection concluded at 14:05. <br /> PERMITTING UPDATE: <br /> RN-06: The application was deemed complete on Feb. 28, 2012, and the fourth and final public <br /> notice was scheduled to appear in the March 31, 2012 edition of the Durango Herald. To date, <br /> the Division has received responses from the Division of Water Resources, History Colorado, <br /> and La Plata County. <br /> AVAILABILITY OF RECORDS —Rule 5.02.4(1): <br /> Mine records were available for review in Tom Bird's office at the King 11 facilities. A <br /> completed DRMS Availability of Records form is attached to this report. <br /> EXCESS SPOIL and DEVELOPMENT WASTE—Rule 4.09 <br /> Placement; Drainage Control; Surface Stabilization: <br /> • At the King I facility, I observed that Coal Mine Waste (CMW) had been used to backfill the <br /> tipple highwall and benches (Photos 1 and 2). The slopes had been graded, and appeared to <br /> be at approximately 4H:1V. The Annual Reclamation Report (ARR) for 2011, dated <br /> February 7, 2012, indicates that 1.09 acres were backfilled and graded. This area is <br /> delineated on the ARR map for the King I Mine. (The Division did not review the ARR until <br /> April 3, 2012.) <br /> • The Division's previous understanding regarding this issue, as documented in various DRMS <br /> inspection reports throughout 2011, indicated that an application for a Technical Revision <br /> Number of Partial Inspection this Fiscal Year: 6 <br /> Number of Complete Inspections this Fiscal Year: 3 Page 2 of 9 <br />
