Revise upland diversion ditches around potable water tank. <br />Install flow meter on Pond 001 outfall. <br />Dear Ms. Scott: <br />The Division received a minor revision application from New Elk Coal Company for the New Elk <br />Mine, in Las Animas County. Our initial review indicates that all preliminary items required by the <br />Colorado Surface Coal Mining Reclamation Act, Section 34 -33 -101 et seq., C.R.S., have been <br />submitted. The application has been considered complete for the purposes of filing as of April 5, <br />2012. All review and comment periods as provided in the Act and the Regulations initiate from this <br />date of filing. <br />A portion of this application addresses installation of a flow meter to the outfall structure of Pond <br />001 (CDPS permit CO- 0000906 outfall 001).The Division had consulted with your office on March <br />8, 2012 regarding the proposed installation. Please review the proposed changes and provide <br />written notice of any concerns prior to April 12, 2012.
