Jim Kiger of Oxbow Mining accompanied me on the inspection. The loadout <br />was processing coal but was not loading any rail cars at the time of the inspection. The weather was cool and <br />overcast and there was some snow on the ground. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltat ion Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring <br />4.05.13; Surface Water Monitoring 4.05.13; Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, <br />4.05.9; Stream Buffer Zones 4.05.18: <br />- The sediment pond contained a small amount of water but was not discharging at the time of the inspection. The <br />emb ankment was well vegetated and stable and no erosional problems were noted. <br />- The ditches along the entrance/haul road and around the coal stockpiles were all clean at the time of the <br />inspection. No erosional problems were noted in any of these ditches. <br /> <br />GENERAL MINE PLAN COMPLANCE : <br />- The Terror Creek Loadout is a loadout only and is only permitted to process coal (sizing coal) and ship coal. The <br />ongoing operations were consistent with what is approved in the permit. <br /> <br />ROADS – Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) Rec lamation 4.03.1(7)/4.03.2(7): <br />- The mine entrance/haul road is paved until it gets into the facilities area then it becomes a dirt road. The road <br />was well maintained and stable at the time of the inspection. No rutting or erosional problems were noted on the <br />road. The outslopes of the road, as it exits old Colorado Highway 133, appeared to be stable as well. There was <br />some minor rilling but nothing to be concerned with at this time. <br /> <br />
