I also compared the ownership and control information provided for Western Fuels- Colorado, LLC and its parent <br />corporation, Tri -State Generation and Transmission Association to the information in AVS. There are a few discrepancies <br />I will need to correct in AVS, and I will need the following information to complete the AVS update: <br />1. Please provide the date that Robert Baca ended his role as a Director of Tri -State Generation and Transmission <br />Association. <br />2. Please provide the date that David Salazar ended his role as a Director of Tri -State Generation and Transmission <br />Association. <br />3. Please provide the date that Elias Coriz was elected a Director of Tri -State Generation and Transmission <br />Association. <br />4. Please provide the date that Daniel Romero was elected a Director of Tri -State Generation and Transmission <br />Association. <br />Also, once MR113 is approved and final, I will need to update AVS to reflect the changes to Rio Tinto White Horse /Taylor <br />Creek Holding Company, Kennecott Colorado Coal Company /Axial Basin Coal Company and the changes in ownership of <br />those two entities (will be owned by Western Fuels- Colorado, LLC). The <br />Decision Due date is November 24, 2011 (Thanksgiving Day). <br />MR -113 proposes to revise the Colowyo Mine permit to reflect a change in mine ownership from Rio Tinto to Western <br />Fuels- Colorado LLC. I am requesting an A /VS check be conducted on Western Fuels- Colorado LLC in conjunction with <br />our adequacy review of this MR. It is our understanding that the actual sale of the Colowyo Mine from Rio Tinto to <br />Western Fuels- Colorado LLC will likely not be finalized until December 1, 2011. Colowyo Coal Company indicated in the <br />MR -113 cover letter that Colowyo Coal intends to file a request sometime next week to extend the Decision Due date to <br />Friday, December 2, 2011, so that when we approve the MR on that date, the change in ownership will have in fact <br />already occurred. <br />
