1. First, in order to issue a completeness determination for II -W RN -5, which I need to do tomorrow (Thursday 6/24), I need to request a couple changes to the proposed public notice that was included with the application. A minor point of clarification, please amend the last sentence of the first paragraph of the Notice to read: "This application is to renew the approved permit for the next five year permit term. Coal extraction has been completed at the mine, and continuing activity under the permit will be limited to reclamation, maintenance, and monitoring." In the next to last narrative paragraph, the final sentence states "No change in land use is associated with this revision ". Please revise the sentence to state "No changes to approved mining and reclamation plans are proposed in the renewal application ". Finally, please revise the final one sentence paragraph of the Notice to read as follows: "Written comments, objections, or requests for an informal conference on the application may be submitted to the Colorado Division of Reclamation, Mining and Safety, 1313 Sherman Street, Room 215, Denver, Colorado 80203 -2273, within 30 days of the final publication of this notice." 2. Second, it appears that we will not be able to issue a proposed decision for the Yoast Renewal RN -3 prior to the end of the fiscal year, and we have already passed the 120th day. We fully intend to issue a proposed decision prior to the 180th day (August 9, 2010). I would much appreciate it you would provide a letter authorizing extension date for Yoast RN -3 until August 9, 2010. Please let me know if you have questions regarding these requests.
