Pineda
Director
We have received your application to renew your permit to conduct coal mining in Colorado. Our
initial review indicates that all preliminary items required by Rule 2.08.5(2)(b) have not been
submitted. Thus, your application is incomplete for the purposes of filing as of February 24, 2012.
Rule 2.07.3(2) includes the requirement that the proposed notice of publication shall include the
precise location and boundaries of the land to be affected by the proposed surface coal mining
operation. As further clarified in 2.07.3(2)(b), this may be accomplished by map or by description.
Please revise the proposed public notice to include 1) a detailed list of the all of the Sections (and
portions thereof) that lie within the permit boundary; or 2) a map which fulfills the requirements of
the rules.
In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make
your application complete.
If you have any questions, please contact me.
Sincerely,
Marcia L.
