If the surface is owned by a person other than the person who intends to explore, give a <br />description of the basis upon which the person who will explore claims the right to enter such <br />area for the purpose of conducting exploration and reclamation (attach supporting <br />documents, if applicable): <br />3.0 Oxbow's right to enter private surface to explore for Federal coal (Rule 2.02.2(2)(e)) <br />Surface Use Agreements will be obtained with each surface owner of record that overlies <br />the Federal coal within this area. Surface access will not be attempted until a surface use <br />agreement has been signed or verbal confirmation that access has been given is obtained. <br />Oxbow claims the right to enter this surface based upon the Act of December 29, 1916 (39 <br />Stat., 862), in which the coal was exempted from the land patents for the United States, and <br />provides for prospecting or exploration of this coal upon approval by the BLM of Federal <br />Coal License # COC- 74911. <br />4 .Attach a description of the land to be affected. For example: The condition of the topsoil, the <br />general hydrology, type of vegetation and topography, Rule 2.02.2(2)(c). <br />4.0 DESCRIPTION OF LAND TO BE AFFECTED (Rule 2.92.2(2)(f)) <br />
