O XBOW MlN/NG,LLC March 30, 2012 Mr. Jason Musick Environmental Protection Specialist Colorado Division of Reclamation, Mining and Safety 1313 Sherman Street, Room 215 Denver, Colorado 80203 Re: Oxbow Mining Oak Mesa, LLC — Notice of Intent to conduct exploration drilling on the Oak Mesa in Delta County, Plan COC -74911 Dear Mr. Musick: RECEIV APR 0 2 2012 Division of Reclamation, Mining and Safety Oxbow Mining Oak Mesa, LLC herein submits the enclosed Notice of Intent (NOI) for Exploration drilling activities associated with future development of the Oak Mesa Property. The drilling program, per this NOI, involves completion of 43 exploration holes, which are located in Delta County as shown on the attached plan maps. In conjunction with drilling activities; in -hole logging, core samples of the roof, coal seam and floor materials will be collected and analyzed to characterize the geotechnical characteristics of the mine roof and floor, as well as determining coal quality of this proposed resource. This NOI application submittal consists of the following: • This transmittal letter • Executed NOI Application Form • Transmittal letters to the Delta County Planning Dept. and Uncompaghre Field office of the BLM. • Two maps showing the general location of the exploration, and the proposed exploration drillholes. • The application files and letters and maps have been submitted to you in electronic format through separate emails. ' Clearance surveys for cultural and paleontological resources have been completed for all but three drillholes, and those three will not be disturbed until surveys around them have been completed. A biological survey has been completed over the entire project area, and the results of that survey can be found in the Environmental Assessment (EA) document prepared by the BLM as a part of the exploration drilling application. The majority of the area affected by this NOI is located in Gambel Oak / Mountain Shrub vegetative communities, and no T &E species were identified during this survey.
