Rob - Linda Keene at AVS hasn't updated the ownership and control information for Colowyo
yet. The current structure in AVS includes ownership by Rio Tinto and Western Fuels -
Colorado, since AVS hasn't removed the link to Rio Tinto yet. I ran an AVS check today and
there were no violations with either parent corporation, so you can approve MR -116. Report
is attached.

Rob - I received follow -up information from OSM /AVS today, regarding the violation reported
for Colowyo. The linking entity is Michael Barrett, via Rio Tinto America Inc, parent
corporation of Rio Tinto White Horse Company and subsequently Colowyo Coal Company, LLC. Mr.
Barrett is tied to an unpaid federal civil penalty associated with a subsidiary of Rio Tinto
America, Inc. of which he is a controller. When AVS is updated to reflect the new ownership
of Colowyo, this will no longer be an issue.
