The linking <br />entity is Michael Barrett, via Rio Tinto America Inc, parent corporation of Rio Tinto White Horse Company and <br />subsequently Colowyo Coal Company, LLC. Mr. Barrett is tied to an unpaid federal civil penalty associated with a <br />subsidiary of Rio Tinto America, Inc. of which he is a controller. When AVS is updated to reflect the new ownership of <br />Colowyo, this will no longer be an issue. <br />In order to get the current ownership and control information for Colowyo updated in AVS, we are still in need of <br />documentation from the appropriate Secretary of State (presumably Colorado) of the name changes for Rio Tinto White <br />Horse and Kennecott Colorado Coal Company. Matt Guptill contacted Linda Keene this morning and told her that he did <br />not have any documentation from the Secretary of State. She advised him to contact his legal department, that they <br />would likely have the documentation. I emailed her this morning and told her that we would follow up with Colowyo to <br />get her what she needed. <br />In addition to the name change documentation, I need the correct Federal Employer Identification Number (FEIN) for <br />Taylor Creek Holding Company; the approved permit application for Colowyo (Exhibit 2) includes two different numbers <br />on pages 2 -3 and 2 -7. <br />Please ask the operator to submit the name change documentation and FEIN for Taylor Creek Holding Company directly <br />to the Division, and we will forward it to the AVS office. Please let me know if you have questions or need additional <br />information. <br />Susan L. I <br />suspect that this violation is tied to former owner Rio Tinto and /or one its partners or subsidiaries. As you are aware, <br />the AVS office has not updated the ownership and control information for Colowyo to reflect the new ownership (now <br />Tri -State Generation & Transmission and its subsidiaries). I have inquired as to the progress of the AVS office in getting <br />Colowyo's information updated; I will let you know what I hear back from them. Meanwhile, I would recommend <br />holding off on making a decision on this revision until I can verify that the violation is not tied to any current owners or <br />controllers of Colowyo. <br />
