Jason; Jones, Thomas; Wagner, George <br />Subject: Moffat County Mining, LLC - Williams Fork Mines (C -81 -044), Mid -Term Review Responses <br />11liiM <br />Attached are our responses to the Mid -Term Review for MCM's Williams Fork Mines <br />As noted in our initial response, MCM holds significant remaining minable reserves, has made a significant financial <br />commitment through payment of advance payments in lieu of royalties on our leases, and has a significant investment in <br />usable mine infrastructure at the site. We have been diligent in maintaining both our permits and the site, through <br />ongoing monitoring and maintenance, and have been pro- active in assessing and reclaiming any facilities for which there <br />is no longer reasonable potential for future use. We believe that these activities justify continued maintenance of both <br />the Permit, and the site, on a care - and - maintenance status, until such time as coal market conditions support re- <br />activation. <br />We anticipate, based both on the content and direction of the Mid -Term Review and our responses, that it would be <br />appropriate to have a joint MCM /CDRMS review and discussion of the status and direction for the Williams Fork Mines <br />at some point in the near future. In the interim, I anticipate providing the supporting revised PAP materials referenced <br />in our responses within the next two weeks. I had hoped to provide these materials with the responses, but the scope <br />and extent of the comments was much broader than I recalled when I initially reviewed the Mid -Term package — <br />Best regards, <br />Jerry <br />Jerry M.
