Division of Reclamation <br />Water Division 1, Water District 3 Mining & Safety <br />Dear Mr. Dains: <br />This letter is in response to your letter dated November 30, 2011, requesting renewal of the <br />above referenced substitute water supply plans to cover depletions caused by gravel mining operations <br />at four locations. This substitute water supply plan is a combined replacement plan that identifies <br />replacement sources to cover depletions from four mine sites along the Cache La Poudre River. The <br />required fee of $1,028 (4 x $257) has been submitted (receipt no. 3653136). The following table lists the <br />sites that are involved in this combined replacement plan: <br />TABLE A - COMBINED REPLACEMENT PLAN SITES <br />Dewatering is not listed as a permitted use. <br />2 Exceeds allowed ground water exposure and evaporation <br />Pursuant to § 37- 90- 137(11)(b), C.R.S. and 2009CW49, a gravel pit operator or property owner <br />does not need to replace depletions that occur due to evaporation from ground water exposed prior to <br />January 1, 1981 (Pre -81) as a result of open mining of sand and gravel, regardless of whether mining <br />continued after December 31, 1980 (Post -80). This SWSP recognizes 25 acres at the East Rigden Pit <br />as being a Pre -81 exposure. Of the 25 acres, 4.5 acres are currently being dewatered.
