March 23, 2012
Division of Reclamation, Mining and Safety
Room 215
1313 Sherman Street
Denver Colorado 80203
RE: King Coal Mine (Permit No. C- 1981 -035)
Permit Renewal Application No. 6 (RN -6)
Dear Sir /Madame:
We understand the above referenced permit renewal does not authorize an increase to mined
or surface area. We are however aware King Coal Mine is currently working on an
Environmental Assessment (EA) with the Bureau of Land Management (BLM) to increase
their coal production and have put them (BLM and King Coal) on notice a land use permit is
required from La Plata County for their mining activities. Section 82 -4 of the La Plata County
Land Use Code requires a Class II land use permit for commercial operations and mineral
extraction operations.
We have been in touch with King Coal in regard to traffic impacts to both County and State
roads and understand they are willing to work with us to identify and mitigate existing and
future traffic impacts. Typically a traffic impact study would be required as part of the EA and
also the County's Class II land use permit process. We are not asking that a traffic impact
study be included as part of your permit renewal application, but wanted to notify you this is an
issue we are working with King Coal Mine to address.
Should you have as gquestions or require additional information do not hesitate to contact me.
Sincerely,
Colorado
QJ
Jim Davis, .E.
- - .Qirector of ublic Works
Copy: Board of County Commissioners
Trent Peterson, V.P. of GCC Energy LLC
Public Works Department
1 1100 I 2 ^ a
813(11
