March 23, 2012 <br />Division of Reclamation, Mining and Safety <br />Room 215 <br />1313 Sherman Street <br />Denver Colorado 80203 <br />RE: King Coal Mine (Permit No. C- 1981 -035) <br />Permit Renewal Application No. 6 (RN -6) <br />Dear Sir /Madame: <br />We understand the above referenced permit renewal does not authorize an increase to mined <br />or surface area. We are however aware King Coal Mine is currently working on an <br />Environmental Assessment (EA) with the Bureau of Land Management (BLM) to increase <br />their coal production and have put them (BLM and King Coal) on notice a land use permit is <br />required from La Plata County for their mining activities. Section 82 -4 of the La Plata County <br />Land Use Code requires a Class II land use permit for commercial operations and mineral <br />extraction operations. <br />We have been in touch with King Coal in regard to traffic impacts to both County and State <br />roads and understand they are willing to work with us to identify and mitigate existing and <br />future traffic impacts. Typically a traffic impact study would be required as part of the EA and <br />also the County's Class II land use permit process.
