OBSERVATIONS <br />PERMIT #: M -1988 -042 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: March 20, 2012 <br />The Cottonwood Pit, File No. M- 1988 -042, was inspected by Peter Hays with the Division of Reclamation, <br />Mining and Safety (Division) as required by the Transfer of Permit and Succession of Operators process and <br />Rule 1.12. Mrs. Julie Mikulas with Martin Marietta Materials, Inc. was present during the inspection. The site <br />was previously inspected by the Division on October 6, 2011. <br />On January 3, 2012, Martin Marietta submitted a Transfer of Permit and Succession of Operators Application <br />Form (SO -03) and selected Option B. By selecting Option B, Martin Marietta choose to not waive their right to <br />a 30 -day processing period and was required to submit a replacement Financial Warranty for the same dollar <br />amount maintained by the current Operator ($421,700.00). On February 1, 2012, the application was deemed <br />complete following the submittal of the appropriate financial and performance warranties. The Division <br />approved the Transfer of Permit and Succession of Operators for the Cottonwood Pit on February, 15, 2012. <br />Martin Marietta is now the permitted operator of the Cottonwood Pit and Lafarge West, Inc. has been <br />released from reclamation responsibility at the site. <br />Financial Warranty: <br />The Division is required to recalculate the required reclamation bond within 60 -days from the date the <br />transfer is completed (April 15, 2012). The Division currently holds a reclamation bond in the amount of <br />$421,721.00, which is adequate to reclaim the site based on this inspection. Martin Marietta will not be <br />required to post additional financial warranty for the site at this time. <br />Hydrologic Balance: <br />The long -term groundwater augmentation agreement with the Water Users Association of District No. 6 <br />regarding the exposed groundwater at the Cottonwood Pit was transferred from Lafarge to Martin Marietta <br />with the sale of the property. <br />Gen. Compliance With Mine Plan: <br />The Cottonwood Pit was active during this inspection. The 2012 Annual Report submitted by Martin Marietta <br />accurately depicted the current mining related disturbance and state of reclamation at the site. <br />The processing plant, scale house and active mining area were contained in mining area CW5. The southern <br />portion of CW5 east of the conveyor is currently being dewatered and mined. The area located west of the <br />conveyor in the southern portion of CW5 will be mined next by Martin Marietta and is expected to be <br />completed this year. CW5 is the final area to be mining at the Cottonwood Pit. The area under the processing <br />plant will be mined at the conclusion of mining activity at the Duckworth Pit located adjacent to the <br />Cottonwood Pit across County Road 20%. <br />Martin Marietta was notified of the requirement to update the mining and reclamation plan maps through the <br />technical revision process for the recently upgraded oil and gas well located in Phase 1 in the middle of mining <br />area CW5. Seven new wellheads were drilled and the pipeline was upgraded and relocated by the oil and gas <br />company in 2011. At the time, the pipeline relocation required Lafarge to move the topsoil stockpile located <br />in the southern portion of CW5 along the eastern boundary. <br />The southern section of mining area CW4 has approximately 2 -3 feet of gravel resources remaining in the pit <br />floor. Martin Marietta expects to complete mining in this area within a month. Following completion of the <br />Page 2 of 3 <br />
