The application also utilized the Division's Guideline Regarding Selected <br />Coal Mine Bond Release Issues, dated April 18, 1995. <br />Public Notice <br />TMI published notice of the bond release application in the Craig Daily Press once weekly <br />for four consecutive weeks, beginning on July 29, 2011. TMI also notified landowners <br />within and adjacent to the mine permit area, and other interested parties of the application for <br />bond release, as required by section 3.03.2(1). The Division received no written comments, <br />objections, or requests for an informal conference regarding the bond release application. <br />Bond Release Inspection <br />The Division conducted a bond release inspection on August 31, 2011. The site inspection <br />was conducted in accordance with Section 3.03.2(2). Attendees included: <br />• Rob Zuber, Colorado Division of Reclamation, Mining, and Safety <br />• Graham Roberts, Trapper Mining, Inc. <br />• Elizabeth Shaeffer, Office of Surface Mining (U.S. Department of Interior) <br />The Division notified the landowners of the inspection via certified mail. <br />Adequacy Review <br />On December 6, 2011; the Division sent an adequacy review letter to TMI in regards to the <br />SL -13 bond release application. One item was cited in the review regarding the inclusion of <br />parcel D -C -99 in the bond release block. Based on Section 4.4.1.5 of TMI's permit, range <br />site C areas should not have been included with range site A and B parcels in a bond release <br />block. The Division requested that parcel D -C -99 be excluded from the SL -13 bond release <br />request. Subsequently, TMI submitted and received approval of a Minor Revision (MR219) <br />to allow small isolated range site C parcels to be included within range site A/B bond release <br />blocks as appropriate. TMI submitted a response to the Divisions adequacy review on <br />February 27, 2012. The Division approved the minor revision since the standards for the <br />A/B bond release blocks are more stringent than those for range site C areas. Given the <br />approval of MR219, TMI requested that parcel D -C -99 to remain part of the SL13 bond <br />release application. <br />A second adequacy review letter was sent to the operator on January 18, 2012. With the <br />original submittal of SL13, TMI included parcel F -AB -01 in the release request. It was cited <br />in the second adequacy review letter that a portion of parcel F -AB -01 was seeded in the <br />spring of 2002. Pursuant to Rule 3.02.3(2)(b) and (d), the ten year liability period for this <br />parcel had not been completed and therefore it was not eligible for Phase III bond release. <br />TMI responded to this issue in their February 27, 2012 letter cited above. TMI removed all <br />39.6 acres of Parcel F -AB -01 from the bond release block. <br />One additional issue was a request from TMI to establish a corridor to the Oak Gulch <br />Trapper Mine Page 4 March 27, 2012 <br />Phase III Bond Release (SL -13) <br />
