The Trapper Mine is an active mine with four active pits and two pits that have been approved <br />to receive flyash. Trapper Mining, Inc. is actively mining coal. Reclamation at the Trapper <br />Mine continues as pits continue to progress. On active mine areas, backfilling and grading, <br />topsoil redistribution, seeding and transplanting will continue. On bond release block "AD &F- <br />ABC", included in this bond release application (SL -13), no additional work needs to be <br />conducted at this time. <br />The Division currently holds a performance bond of $30,173,724.00. Based on the observations <br />above, the Division proposes to release reclamation liability in the amount of $238,793.10 for <br />bond release block "AD &F -ABC 99-01". Should Trapper Mining, Inc. reduce its bond by <br />$238,793.10, the remaining $29,934,930.90 would be sufficient to assure completion of the <br />remaining reclamation work at the site if the work had to be performed by the Division, <br />including the cost of reestablishing vegetation on any revegetated areas, should those areas fail. <br />The reclamation cost estimate was last evaluated and updated in 2010 during the last Mid -Term <br />Review. Backfill and grading, redistribution of topsoil, and re- establishment of vegetation costs <br />were calculated in 2010 on the existing open pits and un- graded disturbances at that point in <br />time. Based on the proposed decision of bond release SL -12, the Division estimated the cost to <br />complete remaining reclamation work at the site to be $28,581,874.34. The decision for SL -12 <br />has not been finalized. Assuming SL -12 will be approved, the Division would further reduce <br />the remaining reclamation liability to $28,343,081.24 for the reclamation tasks associated with <br />SL -13 ($28,581,874.34 minus $238,793.10). <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published <br />once per week for two consecutive in the Craig Daily Press as soon as possible. Requests for <br />public hearing must be submitted to the Division in writing within thirty days following the <br />first publication in the Craig Daily Press.
