Walcher <br />Executive Director <br />Thank you for your letter concerning the proposed construction of a new cement plant near <br />Pueblo. Since there will be a limestone quarry adjacent to this plant, the operator of this proposed facility <br />is required to obtain a reclamation permit in accordance with Colorado Revised Statute 34 -32.5, more <br />commonly known as the Colorado Land Reclamation Act for the Extraction of Construction Materials. <br />The Colorado Division of Minerals and Geology (CDMG), an agency within the Colorado Department of <br />Natural Resources, is responsible for implementation and compliance with this act in the State of <br />Colorado. In checking with the Director of CDMG, I was informed that an application for a 112 <br />Construction Materials Reclamation Permit has been filed by GCC Rio Grande, Inc., for the area <br />described in your letter. The application (File # M- 2002 -004) is currently under review to determine if it <br />meets the requirements for obtaining a reclamation permit and I have forwarded your letter to the CDMG <br />for consideration during this review. <br />If there are objections received during the course of a review, the matter is generally presented in <br />a formal public hearing before the Colorado Mined Land Reclamation Board. As there have been <br />objections received, it is my understanding that this matter is being scheduled for presentation during the <br />August Board hearing. This hearing is tentatively scheduled for August 22, 2002, at the Pueblo <br />Convention Center. You will be notified of the exact time and location of the meeting once it is finalized. <br />One of our greatest challenges in managing Colorado's natural resources is balancing the need for <br />raw materials while ensuring that the environment is protected. To that end, it is the mission of the <br />Division of Minerals and Geology to ensure that mining is conducted in an environmentally sound <br />manner and that mined lands are returned to beneficial use. <br />Once again, thank you for your letter.
