Bruce Humphries
Jim Stevens
Al Amundson
Anthony Waldron
Division of Minerals and Geology
Department of Natural Resources
May 17, 2002
Page 2
had otherwise completed its adequacy determination. As I have indicated to Mr. Waldron, it is
important to us that we make sure we allow a reasonable period of time to allow a technical
dialogue and any needed technical refinements to the application to occur. As such, we
understand that the Mined Land Reclamation Board Rules and Regulations, Rule 1.4.5(3), allows
an applicant up to an additional 365 days to provide additional information to the Division. For
these reasons, we would like to request an additional 45 days to respond to the adequacy
determination, and also request that the Division establish July 8, 2002 as the date by which we
would plan to work through any issues and by which we would provide any additional written
materials to the Division. While we understand that this request will cause the current schedule
to be revised, we think the public's understanding of our process will be better served.
Based upon the positive experience we had in the course of obtaining the facility's air
quality permit from the Colorado Department of Public Health and Environment, a sit -down
technical work session(s) provides an efficient and productive opportunity to continue the
dialogue on technical issues associated with the application. As such, we would like to meet
with the Division on June 5, 2002. Further, given the relationship we have with the State Land
Board and our commitment to continue to work closely with them, we suggest that they also be
involved in the upcoming technical dialogue.
Please let me know if our understanding regarding the Division's availability for a June 5
technical work session is correct and whether we can provide the Division with any additional
information in the meantime. We look forward to continuing the positive technical dialogue
with the Division in the process of developing a draft permit.
cc: Mark Davis
Minerals Director
Colorado State Land Board
Brian McGill
Environmental Manager
GCC Rio Grande, Inc.
