observations appeared to corroborate TMI's hydrologic modeling results of post- mining <br />sediment yields being less than pre - mining yields. <br />Based on TMI's USLE and SEDCAD modeling, the Division finds that the lands proposed <br />for Phase II bond release are not contributing suspended solids to streamflow or runoff <br />outside the permit area in excess of pre- mining levels. <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site <br />inspections, the Division finds that Trapper Mining, Inc. has replaced topsoil and established <br />permanent vegetative communities that support the post - mining land use in accordance with <br />the approved reclamation plan. TMI provided two methods to demonstrate that the reclaimed <br />lands are not contributing suspended solids loads outside the permit area in excess of pre - <br />mining levels. The Division finds both methods are valid. <br />V. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve TMI's request for a partial <br />Phase II bond release for the Trapper Mine. This proposed decision will release the applicant <br />from Phase II reclamation liability for four bond release parcels, totaling 165.5 acres. These <br />parcels include F- AB -05, F- AB -06, Z- AB -05, and Z- AB -06. <br />In the preceding bond releases, SL -01, SL -02, SL -03, SL-04, SL -05, SL -06, SL -07, SL -08, SL- <br />10 and SL-11, the Division released the liability on the bond release blocks but did not return <br />any monies to TMI. An accounting of this bond release history is provided in Table 1. <br />The Trapper Mine is an active mine with four active pits and two pits that have been approved <br />to receive flyash disposal. TMI is actively mining coal. Reclamation at the Trapper Mine <br />continues as pits continue to progress. On active mine areas, backfill and grading, topsoil <br />redistribution, and seeding and transplanting will continue. Reclamation cost liability associated <br />with replacing topsoil on the requested portions of Pit F and Pit Z would have been $695,081.66 <br />based upon a cost per lineal foot measurement of the pit dimensions. The operator did not <br />request a reduction in the bond monies held by the Division in conjunction with this (SL -12) <br />application. Bond release parcels included in the SL -12 Phase II bond release application have <br />not been evaluated for Phase III reclamation success criteria. The reclamation cost estimate was <br />last evaluated and updated in 2010 during the last Mid -Term Review. Backfill and grading, <br />redistribution of topsoil, and re- establishment of vegetation costs were calculated in 2010 on the <br />existing open pits and un -graded disturbances at that point in time. Upon finalization of this <br />bond release (SL -12), the Division estimates the cost to complete remaining reclamation work at <br />the site to be $28,581,874.34 the difference between $29,276,956.00 (2010 Mid -Term Review) <br />and $695,081.66. The Division currently holds a performance bond of $30,173,724.00. TMI <br />did not request that any monies be returned for SL -12. The remaining $30,173,724.00 is <br />sufficient to assure completion of the remaining reclamation work at the site if the work had to <br />be performed by the Division. <br />Trapper Mine Page 9 March 27, 2012 <br />Phase 11 Bond Release (SL -12) <br />
