warmest, wolverine distribution is restricted to high elevations, while at more northerly latitudes; <br />wolverines are present at lower elevations and even at sea level in the far north. Deep, persistent, <br />and reliable spring snow cover (April 15 to May 14) is the best overall predictor of wolverine <br />occurrence in the contiguous United States. <br />Determinations of Effect <br />Based on the above information, OSM has determined that mining and reclamation operations <br />associated with the New Horizon North Mine permit will have the following effects: <br />Mexican Spotted owl (Strix occidentalis lucida) <br />• due to a lack of suitable habitat on or near the New Horizon North Mine permit area, the <br />mining activity will not affect the Mexican Spotted owl <br />Bonytail chub (Gila elegans) <br />• due to the possible occurrence of Bonytail chub in the Colorado River, which receives <br />tributary waters from the project area and an estimated water depletion amount of 42.33 <br />acre -feet per year with a maximum amount in the range of 51.26 acre -feet per year, the <br />New Horizon North mining activities may effect, and is likely to adversely affect the <br />Bonytail chub <br />Colorado pikeminnow (Ptychocheilus lucius) <br />• due to the possible occurrence of Colorado pikeminnow in the Colorado River, which <br />receives tributary waters from the project area and an estimated water depletion amount <br />of 42.33 acre -feet per year with a maximum amount in the range of 51.26 acre -feet per <br />year, the New Horizon North mining activities may effect, and is likely to adversely <br />affect the Colorado pikeminnow <br />Greenback Cutthroat trout (Oncorhynchus clarki stomias) <br />• since drainage from the New Horizon North Mine permit area does not enter the South <br />Platte and Arkansas River drainages, the mining activity will not affect the Greenback <br />Cutthroat trout <br />Humpback chub (Gila cypha) <br />• due to the possible occurrence of Humpback chub in the Colorado River, which receives <br />tributary waters from the project area and an estimated water depletion amount of 42.33 <br />acre -feet per year with a maximum amount in the range of 51.26 acre -feet per year, the <br />New Horizon North mining activities may effect, and is likely to adversely affect the <br />Humpback chub <br />Razorback sucker (Xyrauchen texanus) <br />• due to the possible occurrence of Razorback sucker in the Colorado River, which receives <br />tributary waters from the project area and an estimated water depletion amount of 42.33 <br />acre -feet per year with a maximum amount in the range of 51.26 acre -feet per year, the <br />
