Mike is a ground water specialist and he has carefully and thoroughly
researched the data and mine files regarding the possible source of the seep from a historical perspective and potential
impacts to the North Fork of the Gunnison River. His thorough evaluation and historical perspective regarding the
source of this seep is provided in the attached memo.
Please review this document and consider his recommendation that the NPDES permit be terminated for both the
hillside seep and the sediment pond. We would be happy to meet with you again, in the near future, to discuss any
questions you may have.
As you recall, the Bear Mine Mining and Reclamation Permit will expire on July 19, 2012. Bear Coal Company must
complete any remaining work such as, pond reclamation and ditch construction, by then. None of the site work can be
completed unless the NPDES permit is terminated.
Please feel free to call me or Mike Boulay at 970 -243 -1571 if you have any questions.
Best Regards,
Sandy Brown
j' ands L.
