Rule 2.04:3(1) requires a description of the pre- mining environmental resources within the proposed permit area and adjacent areas that may be affected or impacted by the proposed surface mining activity. Environmental resources within the proposed permit area have been adequately described by WFC, but the Division was unable to find discussion of adjacent areas. Please include a discussion of environmental resources adjacent to the proposed permit boundary. The May -2011 response given by the applicant does not address Rule 2.04.3(1) which requires a description of the existing pre- mining environmental resources in the adjacent areas. The Division agrees that the vegetation types and land uses in the areas adjacent to the proposed mine site area are very similar; however, these adjacent areas have the potential to be impacted by mining activities. Therefore, a description of the existing, pre - mining environmental resources of the adjacent area needs to be included in the permit. Two areas in particular that need to be addressed are the wetlands west of CR 2600, downstream of Meehan Draw and the irrigated pasture and wetland west of CR_2600 adjacent to the Garvey property.
