replacement of overburden, or like measures. <br />(9) The operator understands that where adverse characteristics of the surface exist, and it is not <br />feasible to remedy by artificial measures, that substitute acres may be reclaimed. <br />3.1.11 Buildings and Structures <br />This site is owned by the Orlando and Rose Marie Martinez, and does not fall under the State <br />Historic Preservation Office Requirements for a cultural or history study, however, there is no <br />reason to believe there are any areas of interest to be mined If the operator uncovers any site, <br />the State Historic Preservation Office will be notified. There are no structures except for a ranch <br />fences presently on site, nor are there any permanent structures planned for this site. <br />3.1.12 Signs & Markers <br />(1) The operator will post a sign, which will be clearly visible from the access road with the <br />following information addressed: <br />(a) The name of the operator; <br />(b) a statement that a reclamation permit for the operation has been issued by the <br />Colorado Mined Land Reclamation Board; and <br />(c) the permit number. <br />(2) The boundaries of the affected area will be marked with monuments that are clearly visible: <br />(a) This is a 112 operation, therefore, the permit boundary and the affected boundary <br />may not the same, and the operator /applicant is proposing to disturb only the area <br />shown on the Mining Plan Map Exhibit "C ". <br />(3) The affected land will be monumented for easy delineation. RULE 3.1.13 SPILL REPORTING <br />EXHIBIT D- MINING SUPPLEMENTAL PLAN RULE 3.1.13 SPILL REPORTING <br />The applicant HUERFANO COUNTY GOVERNMENT will prepare a Storm Water <br />Management Plan (SWMP). A Spill Prevention Control and Counter measure (SPCC) plan, for <br />this site if necessary under the EPA rules governing the Scope of the operation. As you know <br />each SPCC plan, while unique to the facility it covers, must include certain elements. The <br />elements required are that the SPCC plan be carefully thought out, prepared in accordance with <br />good engineering practices, and should address operating procedures that prevent oil spills; <br />control measures installed to prevent a spill from reaching navigatable waters; and counter <br />measures to contain, clean up, and mitigate the effects of an oil spill that reaches navigable <br />waters. To meet the above requirements a Storm Water Management Plan and a Fuel Berm <br />Management Plan, plus a Spill Prevention Control and Counter Measure Plan will be done for <br />
