STATE OF COLORADO <br />DIVISION OF RECLAMATION, MINING AND SAFETY <br />Department of Natural Resources <br />On March 21, 2012 the Division of Reclamation, Mining and Safety approved the Technical Revision <br />application submitted to the Division on February 22, 2012, addressing the following: <br />Construction of new Property Discharge Water Treatment Plant. <br />The terms of the Technical Revision No. 19 approved by the Division are hereby incorporated into Permit M- <br />1977 -493. All other conditions and requirements of Permit M- 1977 -493 remain in full force and effect. <br />Although the bond for the site will not be increased as a result of TR -19, the wetland mitigation plan and the <br />cost estimate for construction of 0.46 acre of wetland mitigation as described in Section 4.0 of TR -19 are now <br />incorporated into the Climax Mine Reclamation Permit as a mine reclamation obligation. This work will be <br />guaranteed financially by the Climax reclamation performance bond held by the Division. <br />DRMS understands that Climax intends to begin wetland mitigation concurrent with construction activities <br />beginning in early summer of 2012 to avoid temporal loss of wetland functions. In the event that there is a <br />default on completion of the wetland mitigation, the Division is authorized to make a claim against the <br />reclamation bond to ensure that the wetland mitigation is completed as described in TR -19 and as required by <br />the Section 404 permit issued by the US Army Corps of Engineers. <br />If you have any questions, please contact me. <br />Sincerely, <br />✓Eric C.
