March 7, 2012 C- 1981- 012/New Elk Mine JHB <br />that has been deposited on the north side of the concrete push wall needs to be cleaned up and brought back to the <br />pile. This area is still contained within the sediment control berm and has not had any off -site impacts. <br />Perimeter markers are marked with white painted roof bolts and pvc pipe. Comparison with Exhibit 40 maps finds <br />that several perimeter markers on the NW area of the permit need to be adjusted slightly south to bring the markers <br />into agreement with the map. <br />Sediment control is achieved with berms and several small sediment traps. The berm along the north west side of <br />the loadout has some low spots or breaks where vehicle tires have run over the berm. The berms need to be <br />reshaped in accordance with the design and to assure that all runoff remains within the approved sediment control <br />area. <br />Sediment control berms on SE area of the load out need better definition, particularly adjacent to the bridge at the <br />Colorado Canyon Arroyo. <br />NECC informed the Division that the Railroad, BNSF, had brought in additional road base material and gravel to <br />raise the roadbeds and ramps up to comply with railroad requirements both within the Jansen load out area and on <br />areas outside of NECC's permit area. NECC needs to assure that the additional material on the load out roads is <br />configured to allow the approved sediment control design to function, and removal of this additional material <br />needs to be included in the Reclamation Cost Estimate. <br />NECC anticipates using a tree sap /water mixture for dust control on the coal stockpile. No blowing dust concerns <br />were observed during the inspection. Coal fines were noted outside of the permitted loadout to the east that appear <br />historic. NECC needs to assure that all runoff stays within the sediment control system of the load out. <br />TOPSOIL — Rule 4.06 Removal 4.06.2; Substitute Materials 4.06.4(4); Storage and Protection 4.06.3; <br />Redistribution 4.06.4: <br />The topsoil storage stockpile west of the main Haul road has been graded and appears stable. Bobby Steele alsc <br />indicated that additional shaping was planned for the subsoil pile.
