Prior to claiming any credit for the water returned to the stream system from dewatering in <br />excess of lagged dewatering depletions (a net accretion), the applicant must install a <br />totalizing flow meter that accurately measures the quantity of water being pumped and <br />returned to the stream system via dewatering operations. No net accretion credits will be <br />given to any dewatering operation whose volume is based on the assumed <br />dewatering flow rate after March 30, 2012. <br />7. This SWSP will not be renewed until all dewatering operations have a totalizing flow <br />meter installed, regardless if the result is a net accretion or net depletion. <br />8. The installation of any device used for measuring replacement water in this plan must be <br />inspected by a Division 1 hydrographer. Furthermore, the exact location of all return <br />structures utilized in this plan must be provided to the Division Engineer and Water <br />Commissioner in order to allow for inspections of the structures. Finally, all charts or other <br />output data associated with each measuring device utilized in this plan must be provided in <br />a timely manner acceptable to the Water Commissioner. <br />9. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. In addition, the applicant shall maintain daily records <br />of all diversions, replacements, and the amount of water used for each particular purpose. <br />The applicant shall provide a report of these records to the division engineer and the water <br />commissioner on a monthly basis on a form approved by them. The accounting must be <br />submitted to the division engineer in Greeley (DivlAccountinq @state.co.us) and the water <br />commissioners William Schneider (William.Schneiderstate.co.us), George Varra <br />(George.Varra.Ca�state.co.us), Shera Sumerford ( Shera.Sumerford(a,,state.co.us), and Bob <br />Carlson (Bob.Carlsonstate.co.us) within 30 calendar days of the end of the month for <br />which the accounting is being made. Submitted accounting shall conform to the <br />Administration Protocol "Augmentation Plan Accounting, Division One — South Platte River" <br />(attached) <br />In addition, the applicant shall verify that each entity making replacements for this plan, <br />have included this plan in their respective accounting submitted to the Division Engineer. <br />For this plan those entities are the City of Westminster, City of Thornton, City of Greeley, <br />and Centennial Water and Sanitation District. <br />10. All releases of replacement water must be sufficient to cover all out -of- priority depletions in <br />time, place, and amount and must be made under the direction and /or the approval of the <br />water commissioner(s). The release of replacement water may be aggregated to maximize <br />beneficial use. The water commissioner(s) and /or the division engineer shall determine the <br />rate and timing of an aggregated release. <br />11 The approval of this substitute water supply plan does not relieve the Applicant and /or <br />landowner of the requirement to obtain a Water Court decree approving a permanent plan <br />for augmentation or mitigation to ensure the permanent replacement of all depletions, <br />including long -term evaporation losses and lagged depletions after gravel mining operations <br />have ceased. <br />12. The replacement water, which is the subject of this plan cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this substitute water supply plan, the <br />replacement water must be appurtenant to this site until a plan for augmentation is obtained. <br />All replacement water must be concurrent with depletions in quantity, timing, and locations. <br />According to an affidavit dated February 29, 2012, the Applicant dedicated the 13.5 shares <br />of the Whitney Ditch Company and 96 shares of the Fulton Irrigating Ditch Company as <br />
