EXHIBIT D <br />RECLAMATION PLAN <br />Mining is anticipated to begin near the midpoint along the northerly line with the topsoil <br />initially being stripped from the north and central 3 to 5 acres and being placed in the <br />northwest acre. It is not anticipated that any topsoil will be replaced before a minimum <br />of 50% of the site has been mined. <br />The maximum gradient for the final exterior slopes created will be 3:1 or flatter as <br />specified by the NRCS Guide Sheet (attached). When completed final surfaces have <br />been created, the topsoil will be loosely applied to a depth of 4 to 8 inches. Seeding will <br />take place between July 1 and July 30. <br />The seed mix will be 1.5 pounds of Crested Wheat grass (variety Ephraim or Fairway), <br />2.0 pounds of Western Wheat grass (variety Arriba), 0.9 pounds of Indian Ricegrass <br />(variety Nezpar) and 0.5 pounds of Russian Wildrye (variety Bozoiski) per acre to be <br />reclaimed, as per the NRCS recommendations, based on a drilled planting method. As per <br />the NRCS guidelines, if a broadcast and harrowed planting method is to be used, then the <br />amount of seed to be used will be doubled. All seed referenced above is "Pure Live <br />Seed ". Also, should a particular species /variety not be available or be prohibitively <br />expensive, then as per the NRCS guidelines, that specie will be replaced by one of the <br />others and the seeding rate adjusted back up to 100 %. <br />This property will be utilized as range land after reclamation. Grazing will be deferred for <br />1 to 2 years after seeding to allow for adequate plant establishment. It is not anticipated <br />that any watering will be used for seeding but rather will rely upon planting occurring at <br />the appropriate dates (July 1 to July 31) to allow for the natural wet cycle to assist with <br />germination and establishment of the seeded plants. <br />The above outlined procedure indicates compliance with the NRCS reclamation guide <br />sheet prepared by Mr. Steve Russell, District Conservationist for Rio Grande County for <br />the Smith Pit located in Section 29, Township 40 North, Range 4 East, NMPM, Rio <br />Grande County, Colorado. <br />Total Reclamation cost for the site is estimated to be $10,381.35 as shown on page two of <br />this Exhibit. <br />
