Pineda <br />Director <br />The Division of Reclamation, Mining, and Safety (Division) would like to thank you for your <br />recent visit to the Grand Junction Field Office. Staff reviewed the information submitted for <br />your project and discussed the requirements for dredging operations during your visit. Based on <br />the information supplied and the in person discussions staff has determined that your project <br />does not raise to the level of a prospect or mining operation. <br />This determination is based on the your stated intent to never to have more than two 1600 <br />square foot disturbances at any one time within 1 acre annually although approved for four <br />disturbances of less than 1600 square feet through the US Forest Service. Per the guideline <br />provided to you during the meeting and as an attachment with this letter, as long as you do not <br />exceed the single 1600 square foot or multiple disturbances of 3200 square foot per acre a <br />prospecting permit through the Division is not required. Please be aware that exceeding the <br />limits without a permit is a violation of the law and Vista Mining could be subject to civil <br />penalties and corrective actions. You must also ensure that you meet all other local, state, and <br />federal requirements. <br />Should Vista Mining Adventures wish to exceed the disturbance limitations noted then a <br />prospecting permit will be required. Per our conversation you noted a US Forest Service <br />requirement to reclaim the parking lot associated with the boat launch area. As presented the <br />Division only bonds for reclamation liabilities directly related to a mining activity. It appears the <br />parking lot was not constructed by Vista, is not a direct disturbance in support of your activity, <br />and has multiple party uses.
