"Exhibit A" <br />Conditions for O'Rourke Excavating <br />Instrument kook Page <br />201200413948 OR 558 1433 <br />1. Water shall be on the site at all times for dust abatement on and around the site; <br />2. Hours of operation limited to sunrise to sunset, Monday through Friday and closed on <br />3. Thanksgiving, Christmas and New Years Day with the option of requesting weekend <br />hours if need arises with 48 -hour notice. <br />4. Applicant is responsible for the actions of any subcontractor accessing operation; <br />5. The applicant will consider the aesthetics of the operation t minimize the negative <br />impact on surrounding property owners; <br />6. This permit is issued only to the applicant and is non - transferrable to any subsequent <br />owner; <br />7. The County will notify the applicant of any reasonable and /or legitimate complaints in <br />writing, and the applicant agrees he will immediately cease and desist operations upon <br />receipt of the complaint until such time as the County has approved the corrective <br />action taken to resolve the complaint; <br />8. Failure to resolve any verified complaint within a timely and acceptable manner will <br />result in the withdrawal of the conditional use permit approval; <br />9. The applicant shall apply for and receive the required State Mining permit and will <br />comply with all requirements of that permit; <br />10. Area of Conditional Use shall be a total of 10.45 <br />11. Operation will be shut down on days when winds exceed forty (40) MPH. <br />
