<br />TO HAVE AND TO HOLD the Property, with the hereditaments and appurtenances, unto
<br />Grantee, its heirs and assigns forever. Grantor, for itself, its successors and assigns does covenant and
<br />agree that it shall and will WARRANT TITLE TO AND FOREVER DEFEND the Property in the quiet
<br />and peaceable possession of Grantee, its heirs, successors and assigns, against all and every person or
<br />persons claiming the whole or any part thereof, by, through or under Grantor.
<br />SUBJECT TO the covenants and restrictions more particularly described on Exhibit "C" attached
<br />hereto and incorporated herein by this reference.
<br />THIS DEED, made as of the j day of , 2011, by CHARLES ISGAR, an
<br />individual, and SHIRLEY ISGAR, an individual, (cofll''ectively "Grantor"), and OLDCASTLE SW
<br />GROUP, INC., a Colorado corporation, doing business as Four Corners Materials, ( "Grantee "), whose
<br />street address is 2273 River Road, P.O. Box 3609, Grand Junction, Colorado 81502.
<br />WITNESSETH, that Grantor, for and in consideration of the sum of Ten and No /100 Dollars
<br />($10.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby
<br />acknowledged, has granted, bargained, sold and conveyed, and by these presents does grant, bargain, sell,
<br />convey, confirm, and warrant unto Grantee, its successors and assigns forever, all the real property,
<br />together with improvements, if any, along with all of Grantor's right, title and interest, including any and
<br />all after acquired right, title and interest, in and to all sand, gravel, overburden (soil/rock/shale mixture),
<br />dolomite, sandstone, boulders, scoria, stones, rocks, and water rights (but expressly excluding any other
<br />mineral rights except those listed above) in, on and under that certain land, being in the County of La Plata,
<br />State of Colorado, described as follows (the "Property"):
<br />See Exhibit "A" consisting of 3 pages attached hereto and expressly incorporated herein by this
<br />reference.
<br />TOGETHER with all and singular the hereditaments and appurtenances thereto belonging, or in
<br />anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits
<br />thereof; and all the estate, right, title, interest, claim and demand whatsoever of Grantor, either in law or
<br />equity, of in and to the Property, with the hereditaments and appurtenances, except (i) taxes and
<br />assessments for the year 2011 and subsequent years and (ii) those exceptions listed on Exhibit "B" attached
<br />hereto and incorporated herein by this reference.
