( "Cotter ") to be diverting up to 8 cfs of flow from Ralston <br />Creek past the Schwartzwalder Mine site as specified in Amendment 3, Paragraph 30 of the <br />above referenced Order. There have been several unexpected delays in construction of the upper <br />cutoff wall due to a greater than expected depth of excavation required to reach suitably <br />competent bedrock and the subsequent design changes to accommodate a heavier and taller wall. <br />Specifics of these construction/design delays are as follows: <br />• Excavate an additional 4 -6 feet to attain suitably competent bedrock surfaces (5 days). <br />• Engineering design changes associated with foundation and footer (5 days) <br />• Upgradient bentonite fill layer design change: lead -time for materials procurement and <br />installation (5 days) <br />The construction project engineer projects that the 8 -cfs creek diversion milestone can be <br />achieved by April 12, 2012. Cotter respectfully requests that the 8 -cfs creek diversion deadline <br />as specified in Amendment 3, Paragraph 30 of the above referenced Order, be extended until <br />April 12, 2012. <br />If you have any questions, please contact me at 719 - 275 -7413 (ext. 202). <br />Sincerely, <br />John S.
