development as the mining area progression. Three new terminal EMP ponds will be <br />constructed (EMP -09, EMP -21, and EMP -22) while one reconstructed interior EMP pond (EMP - <br />08a) will be used on a temporary basis. EMP -8a is an existing depression area on the flank of <br />the Schist Island portion of the North Cresson Mine area that is low enough in elevation and <br />accessible to receive storm water runoff from the higher terrain of the North Cresson. EMP -8a <br />has the required capacity of a terminal EMP pond, but will drain by percolation into the <br />diatreme. EMP -09 and EMP -21 will be constructed in approximately 2013 and 2014 to replace <br />the function of EMP -08a when it requires removal due to development of the Cresson Project. <br />Restrictions voluntarily agreed to by CC &V in Teller County regulations limit the amount of <br />disturbance within the boundary of the Historic Recreation Buffer near the City of Cripple Creek <br />to no more than 2.0 acres of disturbance. The Historic Recreation Buffer Boundary is close to <br />the development area limits in several places. Consequently, the construction of ponds and <br />channels may generally be inside or close to the mining boundary. The design presented on <br />Sheets 5 and 6 of Appendix 12, Volume VI shows the plan to be feasible as long as the ponds <br />and channels are constructed as per the presented schedule. Three EMP ponds (EMP -09, <br />EMP -21, and EMP -22) will be located adjacent to the Historic Recreation Buffer, although only <br />EMP -09 will cross and encroach into the area by about 1.2 acres. <br />Existing roadways will be used where feasible for construction of storm water channels. The <br />disturbance within the Historic Resources Buffer will be minimized by implementing this <br />approach. Existing drainage ditches will be re- graded and reshaped to the minimum size shown <br />on the table of Detail 3, Sheet 5. The only encroachment into the Historic Recreation Buffer will <br />be the Lower South interceptor ditch that will be built within an existing roadway, and will affect <br />an additional 0.3 acres. Therefore, the total amount of encroachment within the Historic <br />Creation Buffer will be about 1.5 acres. <br />The sedimentation ponds must also be designed to provide the required capacity as terminal <br />EMP ponds during development of the Cresson Project. That required capacity will vary as <br />mining progresses and storm water basins are sequentially changed during development and <br />subsequently restored during backfill operations. For example, EMP -021 will initially accept <br />storm water runoff from the north as EMP -08a is removed; followed by storm water flow only <br />from the south as Schist Island is backfilled and Globe Hill is developed; and finally will accept <br />storm water flow from the north, south, and east in the final stages of development. During those <br />periods, the area tributary to EMP -09 will also change. The size of the three EMP ponds was <br />chosen for the most critical condition for storm water runoff.
