EXHIBIT U <br />DESIGNATED MINING OPERATION <br />ENVIRONMENTAL PROTECTION PLAN <br />This Exhibit, through reference to Section 14.0 of the Project Description, describes how <br />CC &V will assure compliance with the provisions of the Act and Rules in order to <br />protect areas that have the potential to be affected by designated chemicals, toxic or acid - <br />forming materials, or acid mine drainage. Section 14.0 includes all of the requirements <br />for an Environmental Protection Plan and directs the reader to the appropriate discussion <br />in the Project Description. In addition, this application includes an Emergency Response <br />Plan (Appendix 15, Volume VII) that complies with C.R.S. § 34 -32- 103(4.9) and 34 -32- <br />116.5(5), and Rule 8.3, for designated chemicals used on site, and a Wildlife Protection <br />Plan (Appendix 16, Volume VII) which describes appropriate measures for the protection <br />of wildlife from damage from designated chemicals, toxic or acid - forming materials, and <br />acid mine drainage. <br />
