D. Legal Right to Enter Property Under Negotiation <br />The following parties has granted CC &V the right to enter its property, and to include it within <br />Cresson Project's MLE2 permit boundary, based upon the fact that Cripple Creek & Victor Gold <br />Mining Company is presently engaged in negotiations with the following: <br />1. El Paso Gold Mines (All patented mining claims owned by El Paso Gold Mines Inc., <br />El Paso Gold, Inc., and/or El Paso Lode, Inc., located within. Township 15 South, <br />Range 70 West, Section 25 and Township 15 South, Range 69 West, Section 30). <br />2. Bunce, Donald F M II MD (C /O Mark Soboslai, Atty.): MSID 7452. <br />E. Legal Right to Enter Severed Mineral or Surface Estates <br />As a matter of Colorado common law, a surface owner may use the surface estate in any manner <br />that is not inconsistent with the rights of mineral owner. The surface owner must allow the <br />mineral owner access to his/her property. <br />F. Legal Right to Enter Right -of -Way and Easement Property <br />CC &V has the right to enter Colorado State Highway Department and Teller County Road and <br />Bridge Department Rights -of -Way via permits, and any and all easements, above and below <br />ground, belonging to or granted to BlackHills Energy, CenturyLink (formerly known as Qwest <br />Communications), and Colorado Natural Gas Company. Please see Drawing C2 for location of <br />pertinent roadways, power lines, phone lines, natural gas lines, and water lines. <br />
