Mr. Paul Rosswork
Mr. Chris Hawley
July 28, 2005
Page 3
Western Slope Refining Company completed an investigation in 2002 that determined that there were no
releases of hazardous waste or hazardous waste constituents from two Solid Waste Management Units
(SWMUs), Evaporation Pond No. 7 and Evaporation Pond No. 8, located on the Property. The Division
issued a no further action determination letter for these two SWMUs on September 9, 2002.
The Division suggests that once ownership of the Property is transferred to a new owner, that the new
owner obtain a new address for the Property that is different than those associated with the FMM and
Western Slope Refining Co. U.S. EPA ID numbers. That way if the new owner has the need to obtain a
U.S. EPA ID number in order to notify as a hazardous generator and/or treatment, storage or disposal
facility, the new owner's activities will not be in any way tied to the Former Fruita Refinery.
Please contact me at (303) 692 -3354 if you have any questions.
Sincerely,
David Walker
Hazardous Waste Corrective Action Unit
Compliance Program
Attachments
cc: Dave Younggren, Western Slope Refining Co.
Bill Rothenmeyer, EPA
David Kreutzer, -AGO -
Teresa Bennett, CDPHE/HMWMD
Walter Avramenko, CDPHE/HMWMD
