Based on my review, there are no outstanding requirements
related to the Colorado Hazardous Waste Act (Section 25 -15 of the Colorado Revised Statutes) or the
Colorado Hazardous Waste Regulations (6 Code of Colorado Regulations 1007 -3) associated with the
Property and no notice of violation or compliance order pending or outstanding against the Property.
The Property does contain a landfill area that is subject to the post - closure care requirements of the
Colorado Solid Wastes Disposal Sites and Facilities Act (Title 30, Article 20, Part 1 of the Colorado
Revised Statutes) and the Colorado Solid Waste Regulations (6 Code of Colorado Regulations 1007 -2,
Part B, Section 3.6).
Set forth on page 2 of this correspondence are envirommental conditions known to the Division and in
the public record that have been adequately addressed. There are no other known conditions on the
Property that would prompt the Division to request Western Slope Refining to conduct any additional
investigation and/or remediation of the Property, but please note that we do reserve the right to require
further investigation and/or remediation if as yet undocumented release of hazardous waste or hazardous
constituents is found in the future. Please also note that the Division cannot provide any assurances
regarding conditions at the Property that would be regulated by other environmental divisions of the
Health Department (i.e., Air Pollution Control Division and Water Quality Control Division).
