Box 305 <br />Wynnewood, Oklahoma 73908 <br />�w of CO�o <br />ye �o <br />0 <br />/876 <br />Colorado Department <br />of Public Health <br />and Environment <br />RE: Status of Environmental Activities at the Western Slope Refining Company's Property <br />Associated With the Former Fruita Refinery, Western Slope Refining Company, Fruita, CO <br />81521; COD067315390 <br />Dear Mr. Rosswork and Mr. Hawley:, <br />At your request, I have reviewed Colorado Department of Public Health and Environment (Health <br />Department), Hazardous Materials and Waste Management Division's ( "the Division's ") administrative <br />record for the Western Slope-Refining Company-property-in Fruita; Colorado -that is associated-with -the <br />Former Fruits Refinery ( "the Property"). Based on my review, there are no outstanding requirements <br />related to the Colorado Hazardous Waste Act (Section 25 -15 of the Colorado Revised Statutes) or the <br />Colorado Hazardous Waste Regulations (6 Code of Colorado Regulations 1007 -3) associated with the <br />Property and no notice of violation or compliance order pending or outstanding against the Property. <br />The Property does contain a landfill area that is subject to the post - closure care requirements of the <br />Colorado Solid Wastes Disposal Sites and Facilities Act (Title 30, Article 20, Part 1 of the Colorado <br />Revised Statutes) and the Colorado Solid Waste Regulations (6 Code of Colorado Regulations 1007 -2, <br />Part B, Section 3.6). <br />Set forth on page 2 of this correspondence are envirommental conditions known to the Division and in <br />the public record that have been adequately addressed. There are no other known conditions on the <br />Property that would prompt the Division to request Western Slope Refining to conduct any additional <br />investigation and/or remediation of the Property, but please note that we do reserve the right to require <br />further investigation and/or remediation if as yet undocumented release of hazardous waste or hazardous <br />constituents is found in the future. Please also note that the Division cannot provide any assurances <br />regarding conditions at the Property that would be regulated by other environmental divisions of the <br />Health Department (i.e., Air Pollution Control Division and Water Quality Control Division). <br />
