As discussed at our meeting last November, we will be glad to sit down and <br />discuss the traffic study that will be required along with the Class II land use permit for the proposed <br />expansion. <br />The letter issued by Nancy Lauro (Community Development Dir.) August 29, 2006 to Colorado Division of <br />Reclamation, Mining, and Safety, incorrectly assumed the mining operation was limited to State and Federal <br />land and did not involve private (fee simple) lands. If Nancy was aware the mine operation included fee <br />simple lands she would not have issued that letter. As discussed, our preference is to have a traffic impact study included in the EA to identify <br />the routes, average daily traffic, and potential public safety or maintenance impacts. The county uses the Colorado <br />Department of Transportation State Highway Access Code, Section Two, (5) Traffic Impact Studies, as a guide for all <br />traffic studies. The code is available online at http: / /www.co.weld.co.usf assets /a7lc7b8Dc6cl4Bb7dB2b.pdf <br />In regard to the possible need to obtain a Class It land use permit from La Plata County, I discussed this briefly with our <br />legal and planning departments, and based on what I know about the project and the parcels involved was told a Class II <br />permit would be required. if you have any questions or want to verify this with our planning department please feel <br />free to contact Erick Aune, Director of Planning at 382 -6271, or the office manager Wendy at 382 -6260. A traffic impact <br />study (TIS) would also be required as part of the Class 11 permit process, but if it follows the Access Code, should be <br />sufficient for both the Class 11 permit and your EA. <br />On a final note, I checked with our District I road maintenance to ask if they had any issues with the coal haul trucks, <br />and was told "when we grade that road we have issues with the speed of the trucks and they fail to yield to us the room <br />
