Number of acres historically irrigated: None. <br />ii. Proposed to be irrigated: 213 acres. <br />iii. Legal description of land to be irrigated: The north 213 acres of real <br />property described on the attached Exhibit A and all of the real property <br />described on the attached Exhibit B. A map showing the location of use <br />and irrigated acreage proposed to be served by the foregoing water right is <br />attached as Exhibit C. <br />8. Water Rieht Claim for Tavistock Diversion No. 2. CAM is entitled to a decree for <br />water rights for Tavistock Diversion No. 2 as follows: <br />A. Name of Structure: Tavistock Diversion No. 2. <br />B. Legal Description: SE' /4 SW' /4 of Section 2, Township 1 North, Range 3 West of <br />the Ute Meridian. Distance from section lines: northerly, measured at right <br />angles, 691 feet from the south line of Section 2, Township 1 North, Range 3 <br />West of the Ute Meridian; and easterly, measured at right angles, 1897 feet from <br />the west line of said Section 2. <br />C. Source: Reed Wash, tributary to Colorado River. <br />D. Date of Appropriation: February 11, 2009. <br />E. How Appropriation was Initiated: On -site survey and staking of notice. <br />F. Amount: 0.75 c.fs. conditional. <br />G. Uses: All industrial uses, including, but not limited to, domestic, manufacturing, <br />dust suppression, earth compaction, batch plant uses, product moisture, <br />construction of roads and utility lines, reclamation, augmentation, cooling, <br />commercial, and fire protection. Applicant may divert, store and use the water <br />directly, by and for exchange, augmentation, substitution, replacement or <br />otherwise. A map showing the location of use for the foregoing water right is <br />attached as Exhibit C. <br />CONCLUSIONS OF LAW <br />9. Incorporation. To the extent they constitute legal conclusions, the foregoing Findings of <br />Fact are incorporated herein. <br />
