In 1999, a spill prevention and containment plan for McClane Canyon Mine -was <br />completed in compliance with both the state of Colorado water quality and raixdng <br />permits for the mine. <br />h. Air duality permits for the Mines have also been obtained from the Air Quality <br />Control Division, Co-kwado Department of Health. These permits were r==wed and <br />were also mRdifioed to pamnit an increase in the amount of coal production from. the <br />Mines. In addition, periodic air quality testinS has been performed at the Mines in <br />compliance with the air quality permits and the results have been reported to the Air <br />Quality Control Division. <br />L Applicant and its predecessors engaged in maintenance and improvement of the <br />Mines and related facilities, includis4. (1) design of a waste disposal area for the <br />Munger Canyon mine, a beltline from the mains portals, a screening plant. a coal <br />stacking system, a crushing facility and truck loading area; (2) planning for <br />development of a unit train loadout system, (3) construction of new offices and od= <br />facilities; (4) 'restoration of a Sediment pond and other facilities following a <br />significant 2001 rainstorm at the mine; and (5) overall maintenance, rehabilitation <br />and repair of the Mines and mitring facilities and associated buildings and grounds. <br />,�. After an. interruption is the early - 1990'x, active coal production resumed and bas <br />continued each year since 1999. Durimg the diligence period, approximately 604,000 <br />tons of coal were pi- educed, sold and shipped to customers in western Colorado at as <br />value of approxirmately$ 13,000,000- Furthermore, during 1997, the predecessor in <br />interest mined 50,000r cons -of coal and performed a test btarn of the product in <br />advance of recommencing active mining. <br />k. From 1996 to 1999, a minimum power demand charge was paid to Grand Valley <br />Rural Power Company in the monthly amount of $6,000 to maintain power <br />availability to the Mines. <br />1. The total expenditures required to complete all of the efforts and actions described <br />above was in excess ofS12,000,000. <br />7. EWadv ApyIisatton of fart: As on ownerofthe water right decreed to the Mack Purnping <br />Pipeline and as the owner of the Mitres, and associated lands, facilities and water rights, <br />CANT has the right to use the water right decreed to the Mack Pumping Pipeline for its <br />
