desirable species, will be used for revegetation <br />For Seneca II-W South, no haul roads or topsoil stockpiles will be constructed in the perennial stream <br />16 buffer zone as noted in Tab 13 and associated drawings. The impact of the stream buffer disturbance <br />on the hydrologic balance should be negligible. The disturbance area is minimal and does not affect the <br />main channel. Haul road ditches are properly designed. Salvaged topsoil will be replaced and a seed <br />mix containing native species will be used to revegetate the disturbance area when it is reclaimed. <br />Water Rights and Alternative Water Supplies <br />Introduction. Surface and ground water rights, as well as unrighted water sources within and <br />proximate to the Seneca 11-W Mine have been investigated with regard to the proposed operation of the <br />Seneca 11-W Mine. Table 16-1 provides information such as location, decreed amounts and adjudication <br />dates for the investigated water rights. Exhibit 16-1 depicts the locations of these water rights and <br />unrighted water sources. Water rights were also reviewed for the Seneca 11-W operation and are <br />summarized on Table 16-1 A. This review identified several new water rights established since 1989. <br />Peabody has secured three water rights that will ensure sufficient water during the life of mining for <br />domestic, industrial, and augmentation purposes: 1) Peabody Seneca II-W Mine Pond 006; 2) Peabody <br />Seneca II-W Well No. 1; and 3) Peabody Pond Y-1. Appendix 16-1 contains the "Referee's Ruling" <br />documents for all three rights. This appendix also contains a copy of the well permit issued by the <br />0 State Engineers Office for Seneca II-W Well No. 1. <br />Water Rights Studies and Analyses. A detailed study of water rights in the vicinity of the Seneca II-W <br />Mine was completed by the engineering consulting firm of Tipton and Kalmbach, Inc. in May of 1989. <br />The final report, titled "Water Rights Investigation and Plan for Augmentation" is presented in this tab <br />as Attachment 16-A. This report also includes information related to plans for augmenting water <br />supplies and rights affected by SCC's water usage at the Seneca II-W Mine. Attachment 16-8 presents <br />a study conducted by GeoTrans, Inc. which addressed the long term effects of pumpage from <br />Peabody's supply well (Peabody Seneca II-W Well No. t) on stream flows in the vicinity of the Seneca <br />II-W Mine. Results and conclusions generated by both studies were integral to the plan for <br />augmentation that was approved by the State of Colorado (Office of the State Engineer, Division of <br />Water Resources). <br />Tab 17, Probable Hydrologic Consequences, presents detailed analyses of the effects from the <br />proposed mining operation on the hydrologic system. Both righted and unrighted water sources were <br />considered in these analyses. Tab 18, Hydrologic Reclamation Plan, identifies both surface and ground <br />water installations at which monitoring will be conducted during and after mining for the purpose of <br />detecting significant impacts to the hydrologic balance.
