Box 191 <br />Victor, CO 80860 <br />RE: Cresson Project, DRMS File No. M- 1980 -244, AM -10 <br />Receipt and Notification that Permit Amendment Application is Complex <br />Dear Mr. Comer, <br />STATE OF COLORADO <br />On February 28, 2012 the Division of Reclamation Mining and Safety (DRMS) received <br />your 112d -3 Reclamation Permit Amendment application for the Cresson Project which <br />is located in Teller County. On March 5, 2012 the DRMS determined that the permit <br />amendment application is "filed" as that term is defined in Rule 1.1(20.1) of the Mineral <br />Rules and Regulations of the Colorado Mined Land Reclamation Board. Also on March <br />5, 2012, the DRMS determined that the application is complex as that term is defined in <br />Rule 1.1(10) and reset the decision date for the application from June 3, 2012 to August <br />2, 2012. This was done in accordance with Rule 1.4.1(7). All comment and review <br />periods began on March 5, 2012. <br />Within ten (10) days after your permit is "filed ", you must publish notice in a newspaper <br />of general circulation in the locality of the proposed mining operation once a week for <br />four (4) consecutive weeks. Immediately after the first publication, mail a copy of the <br />notice to all owners of record of surface and mineral rights, holders of any recorded <br />easements, and all owners of record of lands that are within 200 feet of the boundary of <br />the affected land. Proof of notice and mailings, such as Certified Mail - Return Receipt <br />Requested, must be submitted to the Division of Reclamation Mining and Safety prior to <br />the decision date. Additionally, any changes or additions to the application on file in our <br />office must also be reflected in the public review copy which has been placed with the <br />Teller County Clerk and Recorder. <br />COLORADO <br />D I V I S I O N O F <br />RECLAMATION <br />MINING <br />—&— <br />SAFETY <br />John W.
