PEABODY SAGE CREEK MINING LLC February 19, 2012 William & Nance Brandenburg PO Box 381 Hayden, CO 81639 -0381 RE: Red Rock Pit, Permit No. M- 1978 -315 112 Permit Conversion Application CN -1 To The Brandenburgs, Red Rock Pit Peabody Sage Creek Coal Mining LLC; 36600 RCR 27, Hayden, CO 81639 -0250, (970) 276 -7003, has filed an application for a Regular (112) Construction Materials Operation Reclamation Permit with the Colorado Mined Land Reclamation Board under provisions of the Colorado Land Reclamation Act for the Extraction of Construction Materials. The proposed mine is known as the Red Rock Pit, and is located in Section 20, T5N, R88W, 6 PM adjacent to RCR #53. The proposed commencement of operation is May 2012 and the proposed completion is November 2022. The proposed future use of the land is rangeland and wildlife habitat. Additional information and tentative decision date may be obtained from the Division of Reclamation, Mining and Safety, 1313 Sherman St., Room 215, Denver, Colorado 80203, (303) 866 -3567, or at the Routt County Clerk and Recorder's office, 136 6 Street, Steamboat Springs, CO 80477, or the above named applicant. Comments must be in writing and must be received by the Division of Reclamation, Mining and Safety by 4:00 p.m. on (final day for comments) March 9, 2012. Please note that under the provisions of C.R.S. 34 -32.5 -101 et seq. Comments related to noise, truck traffic, hours of operation, visual impacts, effects on property values and other social or economic concerns are issues not subject to this Vice's jurisdiction.
