OBSERVATIONS <br />PERMIT #: M -1994 -097 <br />INSPECTOR'S INITIALS: GRM <br />INSPECTION DATE: February 29, 2012 <br />This inspection is part of the normal monitoring program established by the Colorado Division of Reclamation, Mining, <br />and Safety (Division). The Spring Creek Gravel Pit is a 112c permitted site located south of La Salle Road on 61.25 Road <br />northwest of Montrose. Jason Burkey and Brent Kerr, representatives for Oldcastle SW / United, the permittee, <br />accompanied the inspector on site. <br />The mine identification sign is in place and in compliance with Rule 3.1.12. The sign is located at the entrance to the <br />site. Mr. Burkey and Kerr have a new sign to replace the weathered one. Permit boundaries were noted as fencing <br />along the perimeters of the current mining area. <br />The site is active. Several pieces of heavy equipment were noted on site. A loader was observed moving materials on <br />the pit floor. Numerous stockpiles of processed materials were located throughout the pit area. A large pile of asphalt <br />recycle was observed as well as a pile to be processed. The material is out of any free standing water and away from any <br />stormwater controls. The process sediment ponds in the southern half of the permit are currently empty and appear to <br />be in good condition. <br />Stormwater appears to be being contained on site. Wet conditions were present due to snow and melting. No erosion <br />or sedimentation issues were observed. <br />Some reclamation has been done to slopes on the south and east. Revegetation success is hard to assess at this time. <br />No indications of an infestation of noxious weeds were observed. <br />Fuel storage secondary containment appears adequate and no other hazardous materials were observed. Some on -site <br />mining related debris is documented but is stored in a neat and orderly fashion. <br />The Annual Report submitted on 09/12/2011 reflects current site disturbances and activities. <br />The inspector observed no problems or violations at this time. <br />The financial warranty was reviewed in 2010 as a part of Amendment 3 and therefore not reviewed. The operator is <br />reminded of the 20 acre maximum disturbance commitment.
