Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />Re: North Star Site, File M2012 -004, Incomplete 110 Construction Materials Reclamation Permit <br />Application Package <br />On February 17, 2012, the Division of Reclamation, Mining and Safety received your 110 Construction <br />Materials Reclamation Permit Application package for the North Star site, File M2012 -004. Preliminary <br />review of the information received has identified that application is incomplete. The following items <br />must be received before the Division can consider your application as being submitted and technical <br />review can begin. <br />Signed affidavit stating that notice was posted at site entrance per the requirements of Section <br />1.6.2(1)(b). <br />Application form is missing permitting contact information. (page 2) <br />Application form has not been sealed and signed by the Corporate Secretary. (page 7) <br />Exhibit E requires submittal of both a mining and reclamation plan map. <br />No access agreement with property owner has been provided as required by Exhibit G. <br />Your application will not be considered submitted until the information listed above is received and <br />found sufficient to begin our review. You have sixty (60) days from the mailing date above (February 28) <br />to submit all necessary documents that the Office needs for an application to be considered filed. If, at the <br />end of the sixty day period, the application has not been determined to be complete and filed with the <br />Office, the Office shall deny the application and terminate the application file. <br />A decision date will be established 30 days from the date of receipt of all of the required information. <br />Additionally, if you have already published notice you will need to republish notice, after the Division <br />considers the application submitted. This notice must be published once within ten (10) days of the date <br />your application is considered submitted. We will notify you when you should initiate publication of your <br />notice. The final date for receiving public comments is the 10th day after the publication or the next regular <br />business day. <br />This letter shall not be construed to mean that there are no other technical deficiencies in your application. <br />In fact, many gross inadequacies /errors were noted during the preliminarily review which will need to be <br />addressed before this permit can be approved. For example, the maximum allowable acreage for a 110c <br />permit is 9.9 acres – however the first page of the application form lists 320 acres in Item 3 - twice. It is <br />recommended that the applicant closely review all the requirements for exhibits in Sections 6.2 and 6.3 of <br />the Construction Materials Rule and see that they have been fully complied with. <br />The Division will conduct a full review of your application to determine whether it is adequate to meet the <br />requirements of the Act after submittal of all required items.
