The issuance of this permit does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402 -2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18. 3) Approved pursuant to CRS 37 -90 -137 (2) and (11), on the condition that this well is operated in accordance with the Western Gravel Olathe Augmentation Plan approved by the Division 4 Water Court in case no. 10CW0095. If this well is not operated in accordance with the terms of said decree, it will be subject to administration including orders to cease diverting water. This well (gravel pit ponds) will be known as the Western Gravel Olathe Gravel Pit South Well (2.7 acre surface area) and the Western Gravel Olathe Gravel Pit North Well (1.9 acre surface area), Division of Reclamation, Mining & Safety Permit Number M- 1984 -108. 4) The average annual amount of • round water to be appropriated licit t efeet with the total surface area of the proposed ground _ = ` • 'ti es. 5) The annual use of ground water, in addition to evaporation, is limited to wildlife, fish culture, gravel extraction and stock water. No other use of water is allowed unless a permit therefor is approved. 6) The owner shall mark the well (gravel pit ponds) in a conspicuous place with well permit number(s) and court case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. 7) Pursuant to Rule 10.1.6 of the Water Well Construction Rules, gravel pit wells are exempt from the minimum well construction standards except for contamination considerations as stated in the Rule The owner of the gravel pit shall take necessary means and precautions to prevent contaminants from entering the gravel pit well. 8) The boundaries of the gravel pit ponds shall be more than 200 feet from the location specified on this permit and decreed in Division 4 Water Court case no. 10CW0095, and at least 600 feet from any existing well, completed in the same aquifer, that is not owned by the applicant. 9) Pursuant to P• ' 100 -4 of the State Board of Examiners of Water Well Construction and Pum• Installation Contractors (Boa Yrdq) n net •j 11 4 jsl r1�r'at�l i 11p iM1 i Sit 10) If a pump is to be installed in this gravel pit well, a totalizing flow meter must be installed so as to measure any pumping from this gravel pit pond and maintained in good working order. Permanent records of all diversions from the gravel pit pond, tonage of mined product, and the surface area of ground water exposure shall be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. , State Engine.
