Schwartzwalder Mine Permit Amendment Application <br />EXHIBIT H - Wildlife Information <br />This exhibit has not changed from the 1983 and 2001 Mine Plan Amendments with the exception of issues <br />related to the Preble's Meadow Jumping Mouse (PMJM). In August 2011, a Biological Assessment from <br />IRIS Mitigation and Design, Inc. was submitted to the U.S. Army Corps of Engineers (USACE), U.S. Fish <br />and Wildlife Service (USFWS), DRMS and other regulatory agencies as part of a Pre - construction <br />Notification report from Wright Water Engineers, Inc. The Biological Assessment was prepared in <br />association with Technical Revision 18 (TR -18) to the mine permit involving a temporary creek diversion <br />project to convey Ralston Creek past the mine site. A Section 404 Nationwide Permit No. 38 for the <br />project was approved by the USACE on November 25, 2011 based in part on a Biological Opinion from the <br />USFWS that critical habitat for the endangered PMJM will be adequately protected under project plans <br />outlined in the Pre - construction Notification. Information concerning the endangered status of the PMJM <br />and related considerations as contained in the above referenced Biological Assessment are incorporated <br />into Exhibit H by reference. <br />February 27, 2012 9 <br />
